3. Booking & Payment

a. Reservation & Deposit

• A non-refundable deposit is required to secure a booking. The remaining balance must be paid before the event date, as per the agreed terms.

b. Cancellation & Refunds

• Cancellations more than 14 days prior to the event: The deposit will be fully refunded.
• Cancellations within 14 days of the event: The deposit will only be refunded if Phototek Inc. is able to secure a replacement booking for the reserved time slot.
• Cancellations less than 10 days prior to the event: No refund will be issued for any portion of the fees paid.

c. Service Modifications

• Any changes to event details (such as time or venue) must be communicated at least 14 days in advance and are subject to availability.

4. Photo Booth Usage Rules

a. Client Responsibilities

• The client must provide a suitable space and power source for the photo booth.
• The client is responsible for ensuring that all guests use the booth respectfully.
• Any damage to equipment caused by guests or the client will result in additional charges.

b. Service Limitations

• PhototekNYC is not responsible for interruptions due to power failures, venue restrictions, or internet issues beyond our control.
• We reserve the right to stop service if unsafe conditions arise.

5. Photo & Media Usage

a. Ownership & Licensing

• Guests may download and share their event photos.
• By using our services, you grant PhototekNYC a non-exclusive license to use event photos for promotional purposes unless you request otherwise.

b. Privacy & Consent

• If you prefer private galleries, you must request password-protected access.
• Guests may request photo removal by contacting us at info@phototeknyc.com.

6. Online Galleries & SMS Photo Links

a. FotoShare.co & SmugMug Photo Hosting

• Event photos may be uploaded to FotoShare.co or SmugMug for viewing and sharing.
• Links to these photos may be shared via email, SMS, or provided as a QR code at the event.

b. SMS Notifications

• By providing a phone number, you consent to receiving photo links via SMS.
• Standard messaging rates may apply.

c. Link Expiry & Data Retention

• Online galleries will remain available for [insert duration] before removal.
• PhototekNYC is not liable for any expired or lost photo links.

7. Copyright & Intellectual Property

a. Website Content

• The client agrees to hold PhototekNYC harmless from any claims related to service use, including guest behavior, venue issues, or equipment malfunctions beyond our control.

9. Termination of Service

We reserve the right to refuse or terminate services without a refund if:

• A client or guest engages in inappropriate behavior.
• There are safety concerns for our staff or equipment.
• The client violates any terms outlined in this agreement.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New York/ United States of America. Any disputes shall be resolved in the jurisdiction of [your location].
